(2) The subletting or re-letting of the apartments provided, as well as their use for purposes other than accommodation, require the prior written consent of the landlord. (3) The customer's terms and conditions shall only apply if this has been expressly agreed in writing in advance. § 2 Conclusion of contract, contracting parties, limitation period (1) The contract is concluded upon acceptance of the customer's application by Aritee Apartments Sonnenschein. This means that a hotel accommodation contract is concluded as soon as the customer places an order by telephone and Aritee Apartments Sonnenschein verbally confirms the booking. Aritee Apartments Sonnenschein is free to confirm the room booking in writing. (2) The contracting parties are the landlord and the customer. If a third party has made the reservation for the customer, they are liable to Aritee Apartments Sonnenschein together with the customer as joint and several debtors for all obligations arising from the hotel accommodation contract, provided that the landlord has received a corresponding declaration from the third party. (3) All claims against Aritee Apartments Sonnenschein shall generally become time-barred one year after the commencement of the regular limitation period of § 199 (1) BGB (German Civil Code), which is dependent on knowledge. Claims for damages shall become time-barred independently of knowledge after 5 years. The reductions in the limitation period do not apply to claims based on an intentional or grossly negligent breach of duty by Aritee Apartments Sonnenschein. § 3 Services, prices, payment, offsetting (1) Aritee Apartments Sonnenschein undertakes to keep the rooms booked by the customer available and to provide the agreed services. (2) The customer is obligated to pay the hotel's applicable or agreed prices for the provision of rooms and any other services used by them. This also applies to services and expenses incurred by Aritee Apartments Sonnenschein to third parties at the customer's request. (3) The agreed prices include the applicable statutory value added tax. If the period between the conclusion of the contract and the fulfillment of the contract exceeds 4 months and the price generally charged by Aritee Apartments Sonnenschein for such services increases, the contractually agreed price may be increased appropriately, but by no more than 5%. (4) Prices may also be changed by Aritee Apartments Sonnenschein if the customer subsequently requests changes to the number of rooms booked, the services provided by Aritee Apartments Sonnenschein, or the length of stay of the guests, and Aritee Apartments Sonnenschein agrees to these changes. (5) Invoices from Aritee Apartments Sonnenschein without a due date are payable without deduction within 10 days of receipt of the invoice. Aritee Apartments Sonnenschein is entitled to demand payment of accrued claims at any time and to demand immediate payment. In the event of late payment, Aritee Apartments Sonnenschein is entitled to charge the applicable statutory default interest, currently 8%, or, in the case of legal transactions involving a consumer, 5% above the base interest rate. Aritee Apartments Sonnenschein reserves the right to prove higher damages. (6) Aritee Apartments Sonnenschein is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter, taking into account the legal provisions for package tours. The amount of the advance payment and the payment dates can be agreed in writing in the contract. (7) The customer may only offset or reduce a claim by Aritee Apartments Sonnenschein with an undisputed or legally binding claim. § 4 Withdrawal by the customer (cancellation)/non-use of the services of Aritee Apartments Sonnenschein (no show) (1) Withdrawal by the customer from the contract concluded with Aritee Apartments Sonnenschein requires the consent of Aritee Apartments Sonnenschein. If this is not granted, the agreed price from the contract must be paid even if the customer does not make use of the contractual services. This does not apply in the event of a breach of Aritee Apartments Sonnenschein's obligation to take into account the rights, legal interests, and interests of the customer, if the customer can no longer be reasonably expected to adhere to the contract as a result, or if the customer is entitled to any other statutory or contractual right of withdrawal. (2) If a date for free withdrawal from the contract has been agreed in writing between Aritee Apartments Sonnenschein and the customer, the customer may withdraw from the contract until then without triggering payment or damage claims by Aritee Apartments Sonnenschein. The customer's right of withdrawal expires if they do not exercise their right of withdrawal in writing to Aritee Apartments Sonnenschein by the agreed date, unless there is a case of withdrawal by the customer in accordance with paragraph 1, sentence 3. (3) In the case of apartments not used by the customer, Aritee Apartments Sonnenschein shall offset the income from renting the apartments to other parties and the expenses saved. (4) Aritee Apartments Sonnenschein is free to demand the contractually agreed remuneration and to make a flat-rate deduction for saved expenses. In this case, the customer is obliged to pay at least 80% of the contractually agreed price for accommodation. (5) The customer is free to prove that the above claim has not arisen or has not arisen in the amount claimed. § 5 Cancellation Aritee Apartments Sonnenschein (1) If a free right of withdrawal for the customer within a certain period has been agreed in writing, Aritee Apartments Sonnenschein is entitled to withdraw from the contract during this period if there are inquiries from other customers for the contractually booked rooms and the customer does not waive their right of withdrawal upon inquiry by Aritee Apartments Sonnenschein. (2) If an agreed advance payment or an advance payment requested in accordance with § 3 (6) above is not made even after a reasonable grace period set by Aritee Apartments Sonnenschein has expired, Aritee Apartments Sonnenschein is also entitled to withdraw from the contract. (3) Furthermore, Aritee Apartments Sonnenschein is entitled to withdraw from the contract for objectively justified reasons, for example if - the written booking confirmation issued by Aritee Apartments Sonnenschein has not been completed, signed, and returned within the period specified in the booking confirmation; - force majeure or other circumstances beyond the control of Aritee Apartments Sonnenschein make it impossible to fulfill the contract; - apartments are booked under misleading or false statements of material facts, e.g., regarding the identity of the customer or the purpose of the booking; - Aritee Apartments Sonnenschein has reasonable grounds to believe that the use of the hotel services may jeopardize the smooth running of the business, the safety, or the public reputation of Aritee Apartments Sonnenschein, without this being attributable to the sphere of control or organization of Aritee Apartments Sonnenschein; - there is a violation of § 1 (2). (4) In the event of justified withdrawal by Aritee Apartments Sonnenschein, the customer shall not be entitled to claim damages. § 6 Provision, handover, and return of apartments (1) The customer shall not acquire any claim to the provision of specific apartments. (2) Booked apartments are available to the customer from 2:00 p.m. on the agreed arrival date. (3) The customer has no claim to earlier provision. (4) On the agreed departure date, the apartments of Aritee Apartments Sonnenschein must be vacated and made available by 10:00 a.m. at the latest. After this time, Aritee Apartments Sonnenschein may charge 100% of the full accommodation price (list price) for the use of the apartment beyond the contractual period due to the delayed vacating of the apartment. If Aritee Apartments Sonnenschein incurs further costs due to the late vacating, these shall also be paid in full by the customer. This does not justify any contractual claims on the part of the customer. The customer is free to prove that Aritee Apartments Sonnenschein has incurred no or a significantly lower claim for usage fees. (5) Pets are not allowed in House 48 (apartment types Adlerhorst, Bienenstock, Fuchsbau, and Rehbett) and are not permitted to enter. (6) The vacation apartment will be handed over by Aritee Apartments Sonnenschein in a clean condition. If there are any defects or if any defects occur during the rental period, the landlord must be notified immediately. (7) The inventory must be treated with care and is intended for use in the vacation apartments only. Moving furniture, especially beds, is prohibited. In the event of use of the vacation apartment in breach of contract, such as subletting, overcrowding, disturbance of domestic peace, or non-payment of the full rental price, the contract may be terminated by the landlord without notice. In this case, any payments already made by the tenant shall remain with the landlord. (8) The tenant is liable for any damage caused by them and their fellow travelers to the rental property and its inventory. If the property key is lost, the tenant shall bear the costs of replacing the locking system. Aritee Apartments Sonnenschein reserves the right to charge an additional fee of €40.00/hour for cleaning costs/expenses that exceed the usual final cleaning costs/expenses. Any defects must be recorded by the landlord. If the tenant wishes to claim on their liability insurance for any damage, they must inform the landlord, stating their name and address, as well as the insurance number. § 7 Liability Aritee Apartments Sonnenschein (1) Aritee Apartments Sonnenschein shall be liable for its obligations under the contract with the diligence of a prudent businessman. Claims for damages by the customer are excluded. This does not apply to damages resulting from injury to life, limb, or health if Aritee Apartments Sonnenschein is responsible for the breach of duty, other damages resulting from an intentional or grossly negligent breach of duty by Aritee Apartments Sonnenschein, and damages resulting from an intentional or negligent breach of typical contractual obligations by Aritee Apartments Sonnenschein. A breach of duty by a legal representative or vicarious agent of Aritee Apartments Sonnenschein is equivalent to a breach of duty by Aritee Apartments Sonnenschein. Should disruptions or defects occur in the services provided by Aritee Apartments Sonnenschein, Aritee Apartments Sonnenschein shall endeavor to remedy the situation upon becoming aware of it or upon immediate complaint by the customer. The customer is obliged to contribute what is reasonable to remedy the disruption and minimize any possible damage. (2) If the customer is provided with a parking space in a garage or on a parking lot belonging to Aritee Apartments Sonnenschein, even for a fee, this does not constitute a safekeeping agreement. Aritee Apartments Sonnenschein shall not be liable for loss of or damage to motor vehicles parked or maneuvered on the premises of Aritee Apartments Sonnenschein and their contents, except in cases of intent or gross negligence. The above paragraph 1, sentences 2 to 4, shall apply accordingly. (3) Wake-up calls are carried out by Aritee Apartments Sonnenschein with the utmost care via the telephone system. (4) Messages, mail, and goods deliveries for guests are handled with care. Aritee Apartments Sonnenschein will deliver, store, and, upon request, forward them for a fee. The preceding paragraph 1, sentences 2 to 4, shall apply accordingly. § 8 Final provisions (1) Amendments or additions to the contract, the acceptance of the application, or these terms and conditions for hotel accommodation must be made in writing. Unilateral amendments or additions by the customer are invalid. (2) The place of performance and payment is the registered office of Aritee Apartments Sonnenschein. (3) The exclusive place of jurisdiction – including for disputes relating to checks and bills of exchange – in commercial transactions is the registered office of Aritee Apartments Sonnenschein. If a contractual partner fulfills the requirements of § 38 (2) ZPO (German Code of Civil Procedure) and has no general place of jurisdiction in Germany, the place of jurisdiction shall be the registered office of Aritee Apartments Sonnenschein. (4) German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws provisions is excluded. (5) Should individual provisions of these General Terms and Conditions for Hotel Accommodation be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply. (6) All translations are based on the German original. The translated version of the German terms and conditions is a courtesy translation and is for informational and internal purposes only.
